These Terms of Use and End User License Agreement (collectively, the "Agreement" or "Terms") constitute a legally binding agreement between you ("User," "you," or "your") and AppDBR ("Company," "we," "us," or "our") regarding your use of our mobile applications, including but not limited to Nouri, and any related services (collectively, the "App" or "Services").
BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.
You and AppDBR acknowledge that this Agreement is concluded between you and AppDBR only, and not with Apple Inc. ("Apple"). AppDBR, not Apple, is solely responsible for the App and its content. The rules for using the App are strictly subject to the Apple Media Services Terms and Conditions.
Subject to your compliance with these Terms, AppDBR grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
AppDBR is solely responsible for providing any maintenance and support services with respect to the App, as specified in this Agreement or as required under applicable law. You and AppDBR acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
AppDBR is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. You and AppDBR acknowledge that AppDBR, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
You and AppDBR acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes a third party’s intellectual property rights, AppDBR, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You and AppDBR acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement, and that upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
Certain features of the App may require a paid subscription ("Premium Features"). By choosing to purchase a subscription, you agree to the following terms, which comply with Apple's App Store Review Guidelines regarding auto-renewable subscriptions:
You agree not to use the App in any way that violates any applicable local, state, national, or international law or regulation. You must not submit, upload, or transmit any data, images, or content that is offensive, defamatory, or infringes upon the intellectual property or privacy rights of any third party.
For apps utilizing artificial intelligence for visual, aesthetic, or facial analysis (e.g., Nouri): The App processes data using third-party AI services (e.g., Google Gemini API) solely to provide real-time estimations, scores, and informational suggestions. The results and suggestions generated by the App are for entertainment and informational purposes only and do not constitute professional, medical, dermatological, or psychological advice. AppDBR makes no guarantees regarding the accuracy, scientific validity, or reliability of any AI-generated outputs.
Your privacy is important to us. By using the App, you agree to the collection, use, and disclosure of your personal information, including sensitive biometric/face data, as described in our Privacy Policy. For detailed information on our strict zero-retention policy for face data, please refer to our Privacy Policy.
THE APP AND ALL CONTENT AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. APPDBR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
IN NO EVENT SHALL APPDBR, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP OR THESE TERMS.
